Terms of Service

These Terms of Service ("Terms") govern your use of the Explorly iOS application, related online services, and explorly.app (together, the "Service"). The Service is provided by Explorly ("Explorly," "we," "us," or "our").
By creating an account, selecting an option that accepts these Terms, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be legally capable of agreeing to these Terms. If you are below the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. The Service is not directed to children under 13.
2. The Service
Explorly helps you explore destination information, mark visited and favorite places, keep a private travel history, view statistics and achievements, and optionally receive likely-visit suggestions.
You may browse parts of the Service through a guest session. Saving visits, favorites, profile photos, or other account-based information may require a registered account. Features may differ by device, operating system, account status, location, or Service version.
3. Accounts and Security
- You must provide accurate registration information and keep it reasonably current.
- You are responsible for safeguarding your credentials and for activity under your account.
- Do not share passwords or access tokens or allow unauthorized use of your account.
- Notify us at [email protected] if you suspect unauthorized access.
- You may register with email and password or use an available third-party sign-in provider. A provider's own terms and privacy policy also apply to its service.
4. Location Suggestions and Notifications
Location access and notifications are optional. If you enable location suggestions, Explorly may use significant location changes to identify a country or city you may have visited. Suggestions can be delayed, incomplete, or inaccurate. Explorly never creates a visit until you explicitly confirm it.
Do not rely on Explorly for navigation, emergency assistance, personal safety, border or visa requirements, or proof of your physical presence. You can change location and notification permissions in iOS Settings.
5. Your Content
"Your Content" includes visit notes, profile photos, and other material you choose to upload or save. You retain any rights you have in Your Content. You grant Explorly a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for technical display, and process Your Content only as needed to operate, secure, and support the Service.
You represent that you have the rights needed to submit Your Content and that it does not violate law or another person's rights. Do not upload illegal, harmful, infringing, deceptive, or malicious material. Your travel notes and profile information are not intended for public distribution through the current Service.
6. Acceptable Use
You may not:
- use the Service for an unlawful, fraudulent, abusive, or harmful purpose;
- interfere with the Service, probe its security, bypass access controls, or introduce malicious code;
- scrape, harvest, or systematically extract Service content except where applicable law expressly permits it;
- attempt to access another person's account or information without authorization;
- impersonate another person or misrepresent your affiliation;
- reverse engineer or modify the Service except where that restriction is prohibited by law; or
- use the Service or its data to build or train a competing dataset, product, or service without permission.
7. Destination, Map, and Currency Information
Destination descriptions, images, maps, boundaries, population figures, calling codes, currencies, exchange rates, and similar information may come from third-party or public sources. They may be incomplete, delayed, inaccurate, or unavailable. Geographic names and boundaries do not express a political position or legal determination by Explorly.
Currency conversions are estimates for general information only and may differ from bank, card, cash, or market rates. Explorly does not provide financial, legal, immigration, medical, safety, or professional travel advice. Confirm important information with an authoritative source before relying on it.
8. Achievements, Rankings, and Statistics
Achievements, completion percentages, rankings, percentiles, and comparisons are recreational features calculated from available Service data. They do not provide a prize, monetary value, official certification, or proof of travel and may change when data or calculation methods change.
9. Third-Party Services and Content
The Service may depend on or link to third-party services, including Apple, Google, Meta, maps, content-delivery, authentication, email, cloud-hosting, and destination-data providers. Their terms and policies govern your use of their services. Explorly is not responsible for third-party services or for content outside our control.
10. Explorly Intellectual Property
Except for Your Content and identified third-party material, the Service—including its software, design, branding, text, organization, and original content—is owned by or licensed to Explorly and protected by applicable intellectual property laws.
Subject to these Terms, Explorly grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for lawful, non-commercial purposes. No other rights are granted.
11. Feedback
If you send ideas or feedback, you allow us to use them without restriction or compensation, provided we do not identify you publicly without permission. This does not give us ownership of Your Content or personal data.
12. Account Deletion and Termination
You may delete a registered account from Profile → Settings → Delete account. Our Privacy Policy explains what deletion does and how long certain records may remain.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create security or legal risk, or use the Service unlawfully. Where reasonable, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive termination—including ownership, disclaimers, and liability limitations—will survive.
13. Service Availability and Changes
We work to keep Explorly available, but we do not guarantee uninterrupted or error-free operation. We may update, modify, suspend, or discontinue features for security, legal, operational, or product reasons. Where a material change adversely affects users, we will provide notice when reasonably possible.
14. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
15. Limitation of Liability
To the maximum extent permitted by law, Explorly will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, opportunities, or goodwill arising from use of or inability to use the Service.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable. Mandatory consumer protections in your country of residence remain unaffected.
16. Governing Law and Disputes
These Terms are governed by the law applicable to the provider of the Service, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections or courts available under the law of your country of residence.
Before starting formal proceedings, please contact us so we can try to resolve the issue. You may also have the right to use a local consumer-protection or dispute-resolution process.
17. Changes to These Terms
We may update these Terms as the Service or applicable requirements change. We will post the revised Terms here and update the effective date. For material changes, we will provide additional notice when appropriate. Continued use after revised Terms take effect constitutes acceptance where permitted by law.
